Maritime Update: Vessel Insurer Could Limit Liability to Same Extent as Vessel Owner

On August 29, 2018, the US Court of Appeals for the Fifth Circuit, in the case of SCF Waxler Marine v MV Aris T, dismissed the appeal of a lower court decision for lack of appellate jurisdiction. The appeal was of the ruling by the district court that the defendant vessel’s insurers could limit their liabilities to the same extent available to the vessel owner.

The court held that the lower court ruling was an interlocutory matter that would remain available for review upon appeal of any final decision of the entire case.
